Information Collection and Use
You can generally visit our Site without having to submit any personally identifiable information about yourself to us. However, to use certain Services and certain functionality of the Site, such as to create a Poolside Profile (“Poolside Profile”) or post a service opportunity (“Listing”), you will be required to register for an account with Poolside. When you register for an account, we will collect some of the following information, depending on whether you are a Service Provider or a Customer:
your email address to create a user profile and to send you emails;
full user name to create a user profile;
your mobile number to send text or call notifications, if applicable;
your address or the location you specify to look for job opportunities nearby;
your current work status to connect you to service opportunities that match your skill and resume;
if you include it, your reference(s)’ full name to vouch for your experience;
if you include it, your reference(s)’ email address and/or telephone number to contact your reference to validate your experience;
your work history;
your availability so that Poolside can match you with restaurants that match your availability;
your personal skills as they may be relevant to any openings for service providers which a Customer is seeking to fill;
your personal preferences for a working environment so that Poolside can match you with restaurants that fit your preferences; and/or
your IP address, location information and other information that may be collected via cookies and other tracking technology (see Cookies and Tracking Technology below), which help us provide a more functional and high quality user experience.
We may use your personally identifiable information to register you to use our Site and to provide our Services to you, contact you to deliver certain Services or information you have requested, verify your authority to use the Site, to sign you up to receive certain third-party services, to detect fraud, improve the content and general administration of the Site. We may use the personal identifiable information to verify your identity, though we have no obligation to do so. We may also send you targeted marketing and promotions regarding the Site. If you do not wish to receive these marketing or promotions from us, you may opt-out as set forth in each message you may receive from us.
Poolside recognizes the privacy interests of children and we encourage parents and guardians to take an active role in their children's online activities and interests. The Site is not directed to, and does not target, children under the age of 16. Poolside does not knowingly collect personally identifiable information from children under the age of 16. If your child has provided personally identifiable information, please contact us so we can delete it.
Cookies and Tracking Technology
Cookies and Pixel Tags
We may use small text files called cookies to improve overall Site experience. A cookie is a piece of data stored on the user's hard drive containing information about the user. A pixel tag (also known as a web beacon) is a small string of code that represents a clear graphic image and is used in conjunction with a cookie. A pixel tag allows us to capture certain additional types of information about a visitor's actions on a web site, such as a visitor's cookie number, the time, date, duration and number of page views, a description of the page where the tag is placed and details about any items that were purchased. Pixel tags help us analyze our users’ online behavior and measure the effectiveness of our Site and our advertising. We work with service providers that help us track, collect and analyze this information.
We generally use session cookies to save your preferences and such cookies expire when you close your browser. We also use persistent cookies to authenticate users and for support for the internal operations of our Site. Poolside may track users over time and over our Site, but we do not respond to browser “do not track” signals.
Third parties such as providers of external services like web traffic analysis services may also track users over time and over our Site and third party websites, and such third parties may also place cookies, beacons or similar tracking technology on your device via our Site. These cookies are likely to be analytical, performance cookies or targeting cookies, including:
Google Analytics: Google Analytics cookies are used as Poolside contracts with Google as a third party vendor. These cookies collect information about how visitors use a website, for instance which pages visitors go to most often, and if they get error messages from web pages. All information these cookies collect is aggregated and therefore anonymous. It is only used to improve how a website works. Clickstream data is a record of your activity on the Internet. This data is recorded whenever you click anywhere in a webpage or application and is used for the purposes of collecting, analyzing and reporting data about how you use the Site. This method of data collection is used to capture non-personal information and improve the user experience.
Social Plugins on Our Site
We may use social plugins on our Site and may include icons that allow you to interact with third-party social networks such as Twitter, Instagram, LinkedIn and Facebook. For example, you may sign in to the Site with Facebook, include your social media profile in your Listing and you may “like” us on Facebook or follow us on Twitter. The third-party social plugin may set a cookie when your browser creates a connection to the servers of such social networks and the plugin may transmit your data to the social networks. Your use of these social plugins is subject to the privacy policies of the third-party social networks.
Through third-party analytic providers, as discussed above, and directly through our Site, we may track information that will be maintained, used and disclosed in aggregate form. For example, without limitation, the total number of visitors to our Site, the number of visitors to each page of our Site, browser type, External Web Sites (defined below) linked to and IP addresses. We may analyze this data for trends and statistics in the aggregate, and we may use such aggregate information to administer the Site, and gather broad demographic information for aggregate use.
Certain personally identifiable information that provide may be publicly available on the Site. If you are a Service Provider, we may transmit your personally identifiable information, including, without limitation, your name, contact information, and username to a Customer with a potential service opportunity. If you are a Customer, we will transmit your personally identifiable information, including, without limitation, your name, contact information and username to the potential Service Providers who may be interested in, or a good match for, your Listing.
We may provide your personally identifiable information and the data generated by cookies and the aggregate information to the vendors and service agencies that we may engage to assist us in providing our services to you for their use solely to provide us with such assistance. For example:
our Site is hosted by a third-party hosting providers Amazon Web Services and Google Cloud Platform;
we may use Mail Chimp to manage our email solutions;
we use Google Analytics;
we may use Green House to help manage our applicant tracking system database;
we may use HubSpot for customer relationship management services;
we may use TypeForm to send surveys and capture feedback
we work with third-party advertisers, such as Facebook Custom Audiences (see Third-Party Advertising Partners); and
we may use third party payment processors to process your payments.
We will not sell your personally identifiable information to any company or organization. However, some of our partner providers send leads to us and we will notify those partners of which of the leads used our Services. Additionally, we may transfer your personally identifiable information to a successor entity upon a merger, consolidation or other corporate reorganization in which Poolside participates or to a purchaser or acquirer of all or substantially all of Poolside's assets to which this Site relates.
Third-Party Advertising Partners
In addition to the information about your visits to our Site, our ad-serving partners may also use the information about your visits to other, non-affiliated websites to target advertisements for Poolside.
Currently, we use third party-placed tracking pixels and cookies from the following advertising delivery partners: Google, Facebook, Bing. In the future, we may partner with other companies to provide interest-based advertising, both on and off the Site. If this occurs, we provide you an opportunity to opt out when these advertisements are served.

Facebook Custom Audience Ads
We may display interest-based ads to you when you are using Facebook through a tool offered by Facebook called the Custom Audience Tool. This tool, which is also known as “re-targeting”, allows us to personalize our ads based on your use of and experience with Poolside. In using the Custom Audience Tool, we do not share any of your personal information, including how you use our Services or the Site, with Facebook: Poolside simply converts your e-mail address to a unique number, which Facebook then uses to match to unique numbers that Facebook generates from the e-mail addresses of its own users.

If you have opted in to receive marketing e-mails from us and wish to unsubscribe, you can do so by clicking on the Unsubscribe hyperlink at the bottom of the marketing e-mail you receive. We will note in our database that you have elected to opt out of future e-mails from Poolside. Your record will still remain in our database; however, you will no longer receive any future mailings unless we manually opt you back in.
You may also choose to opt out of receiving marketing e-mails by sending an e-mail to us at firstname.lastname@example.org. If you choose to opt out with this method, please be sure to include the e-mail address that you would like us to unsubscribe.
External Web Sites
Security and privacy go hand-in-hand. As such, we employ procedural and technological measures that are generally consistent with industry practice. Such measures are reasonably designed to help protect your personally identifiable information from loss, unauthorized access, disclosure, alteration or destruction. Poolside may use encryption, secure socket layer and password protection to help prevent unauthorized access to your personally identifiable information.
We also require internal privileges to access accounts, and ensure that all of our employees, contractors and any other consultants who may have access to your personally identifiable information do so subject to strict confidentiality agreements.
Unfortunately, no method of transmission over the internet or electronic storage is perfectly secure. While we work hard to protect your personal information, we cannot guarantee its absolute security. In the event that any information under our control is compromised as a result of a breach of security, Poolside will immediately take reasonable steps to investigate the situation and where appropriate or required by applicable law, notify those individuals whose information may have been compromised as well as any governmental authorities in accordance with any applicable laws and regulations.
You are responsible for maintaining the secrecy of your unique password and account information, and for controlling access to your email communications from us, at all times. We cannot ensure or warrant the security of any information that you transmit to us, or guarantee that information on the Site may not be accessed, disclosed, altered, or destroyed. Your privacy settings may also be affected by changes to the functionality of third-party sites and services that you link to the Site, such as social networks. Poolside is not responsible for the functionality or security measures of any third party.
We will only keep your personal data for as long as necessary to fulfill the purposes for which we collected it in the first place, including for the purposes of satisfying any legal, accounting, or reporting requirements. To determine the appropriate retention period for personal data, we consider the amount, nature, and sensitivity of the personal data, the potential risk of harm from unauthorized use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal requirements. By law we have to certain information about our customers, or as may be necessary in connection with a legal dispute.
Updating Personally Identifiable Information
Poolside provides you with the ability to review and update the registration information that you provide to us by accessing and modifying this information in your account online or by contacting us at email@example.com. In addition, if you consent to reviewing notifications via text or phone call, you may later opt out of receiving such communications by emailing us at firstname.lastname@example.org.
